Abstract
The increasing prevalence of economic crimes such as corruption and money laundering has resulted in significant state financial losses and social injustices. Current legal mechanisms in Indonesia, including asset confiscation provisions in the Corruption Law and Money Laundering Law, are often lengthy and ineffective, allowing perpetrators to conceal or transfer illicit assets. This study aims to analyze the juridical basis and national legal needs to optimize criminal regulations on asset forfeiture, grounded in a progressive and fair legal perspective. Employing normative juridical methods through literature review and qualitative data analysis, the research evaluates existing laws and proposes improvements. The findings reveal gaps in legal provisions, particularly regarding non-conviction based asset forfeiture (NCB asset forfeiture), which can enhance asset recovery without relying solely on criminal conviction. Implementation challenges include conflicts with human rights principles such as presumption of innocence and property rights. The study recommends enacting comprehensive asset forfeiture laws with clear procedures and protections to increase enforcement effectiveness, provide deterrence, and ensure justice. This will strengthen Indonesia’s capacity to recover illicit assets, promote transparency, and uphold the rule of law.
