Abstract
Constitutional Court Decision No. 24/PUU-XXII/2024 has limited the judicial review (PK) efforts for State Administrative Officials (TUN officials) as an attempt to protect citizens' rights and strengthen legal certainty in the administrative judicial process. While normatively aiming to streamline the execution of court decisions, this limitation potentially creates challenges for substantive justice for state functionaries. This provision may hinder the state's ability to rectify erroneous decisions, adapt to changing dynamics, or protect vital public interests through the discovery of new evidence. This study employs a qualitative normative method. It utilizes data referenced from literature and written sources. The research findings indicate that the judge's role is fundamental in seeking material truth and achieving justice for both parties in State Administrative disputes. The application of rechtsvinding by State Administrative Court judges in interpreting Constitutional Court Decision No. 24/PUU-XXII/2024 demonstrates the active role of judges as law-finders (judge-made law) within the administrative justice system. State Administrative Court judges do not merely apply the law textually, but also interpret legal norms constitutionally and progressively to ensure substantive justice. It is crucial to note that when dealing with state administrative officials, judges must consider that these officials also bear the public interest. Although the law guarantees the position of citizens before the law, its implementation must always consider the public interest. The Supreme Court through its Circular Letter (SEMA) does not disregard the Constitutional Court Decision but follows it contextually. However, when cases related to the public interest arise, legal interpretation is necessary to render a just decision. The Supreme Court needs to interpret the specific meaning of the Constitutional Court's decision in the practice of State Administrative judiciary, formulate uniform operational guidelines, and address potential gaps or ambiguities in the implementation of the constitutional decision.
