Abstract

The enforcement of environmental criminal law against corporations in Indonesia still faces serious challenges, particularly in terms of legal certainty and justice concerning the criminal liability of corporate executives. This issue arises from a legal vacuum regarding clear sanction parameters, both for the corporate entity and its executives. This research aims to analyze law enforcement against corporate executives in environmental crime cases and to examine the parameters of criminal liability from a justice perspective. The method used is normative juridical, employing statutory and case study approaches, specifically the District Court Decision of Siak Sri Indrapura Number 9/Pid.B/LH/2021/PN Sak. The findings reveal that law enforcement remains inconsistent, as technical guidelines such as Minister of Environment Regulation Number 7 of 2014 are non-binding and thus not consistently used as a reference by judges. Furthermore, the absence of fair parameters for imposing criminal fines on corporate executives leads to disparities in sentencing. Therefore, a reformulation of regulations is needed to establish clear, measurable, and proportionate sanction guidelines to prevent disparities and uphold legal justice in environmental law enforcement.
