Abstract
This study aims to analyze the annulment of marriage through the application of the Head of the Religious Affairs Office (KUA) due to falsification of identity reviewed from the Marriage Law, Compilation of Islamic Law and related Legislation. In addition, this study also analyzes several decisions of the Religious Court to examine the legal considerations used by the judge in deciding the case. This study is a Normative Juridical study with the problem approach method used is using the Statute Approach and Case Approach. This study shows that the Head of the Religious Affairs Office (KUA) is one of the officials authorized to submit a request for annulment of marriage to the Religious Court, as regulated in Article 23 of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage in conjunction with Article 73 of the Compilation of Islamic Law. The submission of the application by the KUA is a form of law enforcement effort in the field of marriage. In several cases analyzed, the judge considered that the Respondent did not meet the requirements for marriage and had violated the provisions of Article 3 and Article 9 of the Marriage Law due to the falsification of identity by the Respondent. Therefore, the judge stated that the marriage could be annulled based on Article 22 of the Marriage Law. The Head of the KUA and the Marriage Registrar as the Applicant are considered as the parties authorized to file an annulment request. The difference in the case decision is caused by the inaccuracy of the legal basis used by the Applicant in his application letter.
