Abstract

This research examines the legal aspects of copyright registration of songs conducted by unauthorized parties, with a particular emphasis on the protection of the moral and economic rights of the original creators. The method used is normative juridical with a case study approach based on the Supreme Court Decision Number 279 K/Pdt.Sus - HKI/2020. The results indicate that although the copyright registration system in Indonesia is declarative, this mechanism can be misused by parties who are not the creators to claim ownership. Violations of moral rights occur when the name of the original creator is not mentioned or is replaced, while violations of economic rights arise when the work is used commercially without permission. In this case, the Supreme Court decided that the registration of the creation by another party has no legal force and must be canceled. An important finding of this research is the need for a substantive verification system in the registration process to prevent malicious registrations. The novelty of this research lies in the proposal to strengthen the role of the Directorate General of Intellectual Property (DJKI) in ensuring the validity of the parties registering creations. Thus, strengthening regulations and administrative governance becomes crucial to optimally protect the rights of creators in a fair and transparent intellectual property ecosystem.
