Abstract

A land certificate is a document that proves ownership rights to land as the final product of the land registration process. Any transfer of land rights through sale and purchase can only be registered if the legal act of transferring land rights is stated in a deed made by the Land Deed Official. The Indonesian government has taken a strategic step by initiating the transition of land title certificates from physical analog form to electronic form. Normatively (das sollen) electronic land certificates are part of the electronic services that have been issued previously, namely electronic mortgage rights, certificate checking, land value zones, and electronic land registration certificates. Empirical conditions or facts on the ground (das sein) that this policy has pros and cons. The problems that will be discussed in this study are; First, what is the role of the National Land Agency's Agrarian and Spatial Planning Office in land registration in the issuance of electronic land certificates? Second, what is the legal certainty for electronic land certificate holders? The research method used in compiling this thesis is normative legal research or also called the normative legal research method. The normative legal research method is library legal research which is carried out by examining library materials or secondary data alone. In order to support and strengthen the research, the author also conducted interviews with related parties, such as academics, National Land Agency officers and the general public, with the aim of making the research results more valid. The results of this study conclude that; The role of the National Land Agency's Agrarian and Spatial Planning Office in land registration in the issuance of electronic land certificates is quite enthusiastic in making the electronic land certificate program a success by conducting socialization and inviting several related parties such as Sub-district Heads, Village Heads and PPATs with the hope that through them, socialization of information regarding the transition of land certificates to electronic form can also be conveyed. Another form of socialization that is carried out is through social media such as Instagram, TikTok and Facebook. The author's suggestion is that if the registration is carried out properly, the rights held can receive legal protection. This protection must be accompanied by the realization of the objectives of the law, namely ensuring legal certainty in society and of course the law must be based on justice.
