Abstract

The new Indonesian Criminal Code (KUHP), enacted through Law No. 1 of 2023, has brought significant changes to Indonesia’s criminal policy. These changes include the reform of criminal structures, the addition of new types of crimes, and the reclassification of the death penalty as part of the "decolonization" of Indonesia’s criminal law from its Dutch colonial heritage. Several new provisions have been introduced, including those related to state secrets. This study employs a normative legal research method with a statutory and conceptual approach. The data sources include primary legal materials such as legislation, as well as secondary legal materials such as academic journals and literature. The analysis focuses on identifying the classification of state secret disclosure offenses, the perpetrators— specifically state officials—the contributing factors, and the criminal policies implemented as preventive and enforcement measures. The findings indicate that both the old and new KUHP classify state secrets and identify which state officials have the potential to commit the offense of state secret disclosure. Furthermore, the criminal policy in the new KUHP places greater emphasis on stricter criminal sanctions and the addition of legal norms to enhance state information security.
