Abstract
The advancement of e-commerce facilitates buying and selling transactions, but it also poses risks such as the sale of illegal ex-inter mobile phones that harm consumers. The case of TW who bought an illegal mobile phone on Tokopedia shows the need for an analysis of the civil liability of e-commerce platforms in protecting buyers. This study aims to examine Tokopedia's liability for buyers' losses due to illegal transactions, dispute resolution mechanisms, and available legal protections. This study uses a normative juridical method with a statute approach, analyzing the Civil Law Code, the Consumer Protection Law, and Government Regulation No. 80/2019, as well as related literature. Tokopedia is limited to the responsibility of mediating through the Resolution Center, but does not compensate for damages. Thebuyer can sue the seller to the BPSK or the court if mediation fails. The agreement to buy and sell illegal mobile phones is null and void because it violates the objective requirements of Article 1320 of the Civil Code. The need to strengthen seller verification regulations by e-commerce and consumer education. The next research can examine the effectiveness of BPSK or anti-illegal goods policies on digital platforms.
