Abstract
Constitutional Court Decision No. 93/PUU-XX/2022 is the result of a judicial review of Article 433 of the Civil Code, which brings significant changes for individuals placed under guardianship, particularly those with mental and intellectual disabilities. The main issue in this study is how guardianship practices were carried out before and after the Constitutional Court decision, and to what extent this decision promotes more equitable and non-discriminatory legal protection. In its formulation, this study adopts a normative-empirical legal method using a statutory approach, a conceptual approach, and a comparative approach. Data was obtained through literature review and interviews, then analyzed using a descriptive approach, legal interpretation, and critical analysis. The research findings indicate that Constitutional Court Decision No. 93/PUU-XX/2022 brings significant changes in legal protection for persons with mental and intellectual disabilities, emphasizing the importance of individual assessment and the elimination of discriminatory approaches in guardianship. This study concludes that Constitutional Court Decision No. 93/PUU-XX/2022 aligns with the principle of preventive legal protection, which aims to prevent the abuse of guardianship and ensure that the law does not become a tool to reinforce vulnerability or deprive persons with disabilities of their civil rights. Therefore, it is necessary for the government, together with civil society organizations, to conduct outreach on the substantive updates regarding guardianship as established by Constitutional Court Decision No. 93/PUU-XX/2022, followed by the establishment of new regulations specifically governing guardianship.
