Abstract

Wrongful arrest is a legal error related to the determination of a suspect. This mistake reflects a failure to correctly identify the individual who is truly responsible for a criminal act. In cases where a child is wrongfully arrested, such actions may constitute violations of fundamental human rights, including physical abuse, psychological pressure, and legal procedures that do not comply with statutory regulations. The research method applied is normative-juridical, using statutory and case approaches. Data were obtained through literature review, including legislation, court decisions, scholarly literature, and official reports. The findings indicate that legal protection for children as victims of wrongful arrest is provided under Articles 95 and 97 of the Indonesian Criminal Procedure Code (KUHAP), which regulate compensation and rehabilitation. Furthermore, there are adverse impacts experienced by the child victim as well as implications for law enforcement officials. Investigators who engage in wrongful arrests may be subject to criminal sanctions under Articles 333, 335, and 351 of the Indonesian Penal Code (KUHP). In addition, ethical sanctions may also be imposed on law enforcement officers who violate juvenile criminal justice procedures, as stipulated in the internal regulations of the relevant institutions. In this regard, existing regulations on child protection should be reinforced with explicit provisions concerning wrongful arrest cases involving minors.
