Abstract

The development of the music industry in the digital era has increased the widespread use of musical works, including in commercial public services. However, this trend has also led to copyright infringements, particularly when works are used without the permission of the copyright holders. This research is based on the copyright infringement case involving the song "Bilang Saja," which was used commercially by event organizers without the creator's authorization, as decided in the Central Jakarta Commercial Court Decision Number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jkt.Pst. The research problems addressed include the legal protection for copyright holders and the judge's legal considerations in the case. This study uses a normative juridical method with statutory and case approaches. The findings show that unauthorized use of a song violates the creator's economic rights under Article 9(1)(f) and Article 113(2) of Law No. 28 of 2014. The court stressed the necessity of prior consent from copyright holders for commercial use. The study recommends strengthening copyright education and licensing mechanisms through Collective Management Organizations to prevent similar violations.
