Abstract

This research aims to find out what the judge considers in granting a dispensation application based on a study of the decision and the application of the principle of the best interests of the child that should be considered by the panel of judges in creating a better future for the child. The background to this research is a study of the decision that the researcher raised where the reason for applying for marriage dispensation should not be urgent. The panel of judges in their consideration only looked at the benefit aspect to avoid harm, but did not consider other aspects such as education and children's health. The statute approach and case approach are the two approaches used in this normative juridical research. This research uses library research as a data collection technique. This research is organized by presenting facts and information through the application of descriptive data analysis methods, which are then used as the basis for formulating various conclusions which are the main findings in this research. This study explain that it is important to look at various aspects in adjudicating marriage dispensation applications, not just looking at one aspect, because it will affect the future of children who will enter into a marriage
