Abstract
Breach of Contract refers to the failure or negligence of parties bound by an agreement to fulfill their obligations. This study discusses a case of breach of contract committed by PT Desima Teknologi in its cooperation agreement with PT Media Telekomunikasi Mandiri. The breach occurred due to PT Desima's failure to perform its contractual obligations, specifically by not paying its debt on time. Such non-compliance violates Articlel 1338 of the Indonesian Civil Code, which upholds the principle of pacta sunt servanda and the principle of good faith. This research employs a normative juridical method, using legal materials such as legislation, legal journals, and academic literature. The aim of this study is to identify the form of breach of contract and the resulting legal consequences in the relationship between PT Media Telekomunikasi Mandiri and PT Desima Teknologi. The breach of contract in this case has led to legal consequences, namely that PT Desima Teknologi is obligated to pay compensation due to its deliberate failure to comply with the agreement. Therefore, it is essential to adhere to Article 1338 to ensure that agreements are carried out fairly, honestly, and without causing harm to any party.
