Abstract

he procurement of land for toll road construction often faces ownership disputes that hinder the disbursement of compensation. This legal study examines the mechanism of compensation disbursement in land ownership disputes by assessing the suitability of Decision Number 330/Pdt.G/2022/PN.Tng with the applicable laws and regulations. Using a normative juridical method and case study approach, this research finds that consignment is a legal solution to ensure the continuity of land acquisition while protecting the rights of landowners. Although the court decision establishes the plaintiff as the legal heir without direct evidence of a title deed, the ruling is deemed valid as it is supported by other formal evidence. However, the use of a lawsuit in the consignment process is considered procedurally inadequate. These findings highlight the importance of administrative validation and consistent legal application in resolving land acquisition disputes for public interest.
