Abstract

The Draft Law on Asset Forfeiture Without Criminal Conviction in Indonesia aims to expedite the recovery of state assets from corruption and economic crimes that harm the national economy. While offering a solution to overcome legal barriers in asset recovery, this policy raises concerns regarding potential violations of constitutional rights, particularly the principles of due process of law and the presumption of innocence as stipulated in Article 28G of the 1945 Constitution. This study employs a normative legal approach, analyzing existing legislation and conducting comparative studies with countries such as the United States and the United Kingdom. The findings indicate the need for transparent oversight mechanisms, strengthening the role of the judiciary, and providing compensation for affected parties. These recommendations aim to balance the state's interest in combating crime with the protection of individual rights, ensuring that the policy reflects justice and accountability.
