Abstract

Restorative Justice (RJ) in Indonesia's criminal justice system is an alternative approach that prioritises the restoration of relationships between perpetrators and victims through out-of-court settlements. Although the principle of restorative justice has been accommodated in a number of regulations, its implementation in Indonesia still faces various obstacles. This research aims to examine the application of restorative justice in criminal justice in Indonesia, identify procedural differences between law enforcement agencies, and formulate strategies in the establishment of uniform operational standards. This research uses a normative legal method with a statutory and conceptual approach, which analyses regulations and legal principles related to restorative justice. The results show that there is uncertainty and incoherence in the application of restorative justice among the Police, the Attorney General's Office, and the Supreme Court, which is caused by differences in standards, interpretations, and procedures applied by each institution. In addition, the lack of equitable understanding of restorative justice principles among law enforcement officials, as well as overlapping rules and procedural constraints in the formal justice system, are major obstacles to effective implementation. This research highlights the urgency of regulatory reformulation and harmonisation among law enforcement agencies to ensure consistent and justice-oriented implementation of restorative justice. In addition, this research provides recommendations for strengthening the capacity of human resources and improving supporting facilities for law enforcement officials.
