Abstract
The purpose of this research is to review the legal certainty tied to traffic crimes. As well as how it is regulated in national law. This research applies normative juridical legal research methods while linking statutory approaches, case studies and perceptions of legal science theory. Meanwhile, the results of this study imply that there is no deterrent effect in the community against the behavior of smoking drivers on the highway. Because if you look at the lack of public awareness and the lack of law enforcement officials in tackling the act. So, there are still many obstacles faced in order to reduce these actions for the norms in society.
