Abstract
Divorce in the Indonesian legal system is a final step that can only be taken based on certain reasons as regulated in laws and regulations. One of the causes that often occurs in society is infidelity. This article discusses how civil law views infidelity as a basis for a divorce lawsuit, focusing on a case study of Decision No. 855/Pdt.G/2024/PN.Tng. The discussion examines the normative basis, evidence, and legal considerations of the judge in making the decision. The results of the study show that although infidelity is not explicitly mentioned as the sole reason in the regulations, the act can be qualified as a cause of continuous quarrels that meet the requirements for divorce. In addition, the judge's considerations also take into account aspects of child protection and the absence of the defendant as a form of lack of good faith in maintaining the household. This article emphasizes the importance of a comprehensive and sensitive legal approach to social reality in resolving divorce cases due to infidelity.
