Abstract

This study analyzes the legal liability for the use of deepfake technology without consent on social media, focusing on privacy violations protected by the Personal Data Protection Law (UU PDP) and the Electronic Information and Transactions Law (UU ITE). Using a normative juridical approach, this research employs literature study to explore legal principles related to artificial intelligence and privacy, as well as their implications within the context of Indonesian law. The findings indicate that unauthorized use of deepfake involves various parties, including individuals, and corporations providing technology. Individuals and entities involved may face criminal and administrative sanctions, while corporations are required to ensure biometric data processing in accordance with the UU PDP. The study also emphasizes the need for more specific legal regulations regarding deepfake technology to address existing regulatory gaps. Inspired by China’s Deep Synthesis Provisions, Indonesia could adopt key elements to ensure privacy protection and the integrity of personal data in the era of advanced technology.
