Abstract

Traffic safety is a basic right of all road users. The Indonesian National Police Traffic Corps through IRSMS data reported that the final recapitulation of traffic accident data from January to December 22, 2024 amounted to 138,498 incidents with 95% of incidents occurring due to human negligence. Traffic violations due to driving under the influence of alcohol are one of the cases of concern. Law Number 22 of 2009 concerning Traffic and Road Transportation has regulated traffic regulations, including sanctions for drunk driving violations. However, the absence of regulations governing the blood alcohol concentration (BAC) threshold for drivers makes law enforcement against this violation inconsistent. The purpose of this study is to analyze the incompleteness of sanctions for drunk driving violations in Indonesia based on the regulations in Law Number 22 of 2009. This study uses a normative legal research method with a statutory approach and a comparative approach. Legal materials consist of primary legal materials, secondary legal materials, and tertiary legal materials which are analyzed from a normative perspective. The results show that it is necessary to establish rules on blood alcohol concentration (BAC) limits when driving and to determine sanctions for violations based on the classification of blood alcohol concentration (BAC) levels for drivers who violate drunk driving by referring to the Korean Road Traffic Act and World Health Organization (WHO) standards.
