Abstract

This article discusses legal protection for mutual fund investors against investment managers who experience default, focusing on a case study of PT. Narada Aset Manajemen. Since the increasing number of investors in the Indonesian capital market, mutual funds have become one of the popular investment instruments. However, the default case that occurred at PT. Narada, which resulted in significant losses for investors, shows a gap in legal protection. This study uses a normative legal method with a statutory approach and a problem approach that serves to highlight the gap between legal theory and practice in the field and to analyze the responsibility of investment managers based on the Capital Market Law, OJK regulations, and Collective Investment Contracts. The results of the study indicate that PT. Narada has committed default by not fulfilling its payment obligations to investors, which resulted in material and immaterial losses. Although there are legal provisions that regulate sanctions for violations, the implementation of legal protection still faces obstacles, especially in terms of certainty regarding compensation. This article recommends strengthening regulatory frameworks and improving enforcement mechanisms to better safeguard the rights of mutual fund investors in Indonesia.
