Abstract

Law Number 11/2008 on Electronic Information and Transactions is the basis for the position of electronic evidence as evidence that is legally recognised in Indonesian positive law. In theory, electronic evidence is recognised through Article 5 paragraph 1 of Law Number 11/2008 on Electronic Information and Transactions. However, this recognition has not been accompanied by formal law or procedures related to the authentication of electronic evidence by means of digital forensic. This research uses normative legal research methods strengthened by interviews. The results showed that the implementation of digital forensic on electronic evidence has not been evenly enforced due to formal legal factors or procedures that have not regulated, human resources, and inadequate facilities. In addition, when compared to the United States, Indonesia is still lagging behind in various aspects related to the authentication of electronic evidence. In this context, this study encourages Indonesia to immediately reform the formal law that recognises electronic evidence legally, coupled with procedures for authenticating electronic evidence by means of digital forensics, judges' procedures in assessing electronic evidence, as well as increasing human resources and facilities that support digital forensics.
