Abstract
This study examines the role of notaries in validating deeds that may have legal defects. Notaries are crucial in ensuring the legality of the documents they draft, in compliance with relevant laws and regulations. The notarial process, which involves verifying the identity of the parties and confirming their intentions, can lead to legal issues if negligence occurs. The research utilizes a normative approach, combining legal and conceptual perspectives to examine the civil, criminal, administrative, and ethical duties of notaries. The findings suggest that negligence or mistakes during the notarization process can lead to legal defects in the deed, resulting in civil lawsuits, criminal penalties, or administrative sanctions. Additionally, breaches of professional ethics, such as conflicts of interest and lack of neutrality, may damage the notary’s reputation and erode public confidence in the profession. The Supreme Court ruling in case no. 334 K/Pdt/2020 serves as a clear example of how notarial negligence can cause significant financial losses for those involved. This research recommends enhanced oversight, ongoing professional development, and the application of a precautionary approach to mitigate the risks of legal defects. This would help ensure that the notary profession continues to offer strong legal protection and preserve public trust.
