Abstract

Administrative Mining crimes have now occurred so frequently that they have become a serious concern, especially since many companies that have mining business permits and Current Budget Activity Plans are being investigated by the Indonesian Police. The pro yustisia process cannot actually be applied to corporations that have mining business permits and Current Budget Activity Plans because there must be legal action first taken by the Ministry of Energy and Natural Resources Cq. Directorate General, namely administrative efforts in the form of Guidance and Supervision so that in this case there is an overlapping of authority and regulations that result in uncertainty and legal benefits. In this study, normative legal research is used through research on court decisions from the first level to the final decision and from the literature. The results of this research approach, it is necessary to have clear provisions to accommodate special mining administrative crimes for companies that have mining business permits and Current Budget Activity Plans while still considering public interests, legal interests, and state interests. This is done to realize justice in mining criminal cases both in cases in research and cases that may occur in the future.
