Abstract

This research aims to analyze the liability of the Shopee marketplace and the Food and Drug Administration. The background of the problem is the rampant use of Thai cosmetic products by the Indonesian people. People easily buy Thai cosmetic products through the Shopee marketplace, even though many products do not have distribution permits issued by the Indonesian government. This violates applicable regulations regarding the circulation of imported cosmetics in Indonesia. The Shopee marketplace must supervise the circulation of products that are not in accordance with these laws and regulations. BPOM must also carry out stricter supervision as the authorized party. This research uses the juridical-normative method. The lack of maximum supervision over the circulation of Thai cosmetic products that do not have a distribution permit by the marketplace and BPOM is the reason these products can be easily found on the market. The public is also less wise in using imported cosmetic products. This research is expected to be a reminder to tighten the supervision of Thai cosmetic products and a reminder for the public to be wiser in choosing products.
