Abstract

Along with the development of the times, the public's need for public transportation is increasing, one of which is the need for bus transportation for tourism purposes. Good transportation access can encourage tourism development and increase the number of tourists. Although transportation in the tourism sector continues to experience significant development, the risk of tourism bus accidents continues to increase so that it becomes a common problem that road users always face. Frequent accidents on tourism bus transportation are caused by driver negligence factors and the negligence of bus companies which are interrelated. However, in this case, bus drivers are the most vulnerable parties to be made a victim, while bus companies tend to be free from legal entanglements. The purpose of this study is to comprehensively understand the criminal liability mechanism of bus companies based on Law Number 22 of 2009 (LLAJ Law) and to find out preventive efforts so that tourism transportation traffic accidents can be minimized in the future. The research method used is a normative juridical method by collecting data through literature studies. The results of the study show that the LLAJ Law has not set clear limits regarding the criteria for criminal acts that can be committed by public transportation companies. Therefore, a limited revision is needed in the LLAJ Law, especially on the substance of articles related to corporate criminalization.
