Abstract

Work accidents in the construction sector continue to be a serious problem in Indonesia, often caused by company negligence. This results in loss of life and material, as well as loss of security for workers. This research examines the form of criminal liability for work accidents caused by the negligence of construction service companies based on Law No. 1 of 1970 concerning work safety and related laws and regulations and identifies obstacles in its application. Using a normative legal research method with a statutory approach and case studies, this research finds that law enforcement faces various challenges. Lack of legal awareness among companies, limited law enforcement resources, and difficulties in proving negligence are some of the main obstacles. To overcome this, the government needs to improve supervision and strict law enforcement, as well as provide effective sanctions for negligent companies. In addition, companies need to improve the implementation of occupational safety and health management systems (SMK3) and provide adequate training for workers. Overall, a comprehensive and collaborative approach is needed between the government, companies, and workers to reduce the number of work accidents and protect workers' rights in the construction services sector
