Abstract
Forest and land fires in Indonesia have posed a serious threat to environmental sustainability, particularly when committed by corporations engaging in illegal land clearing. This thesis examines the ideal punishment pattern for corporate perpetrators of environmental destruction that results in forest and land fires, using Court Decision Number 71/Pid.B/LH/2021/PN.SNT concerning PT. Mega Anugerah Sawit as a case study. The research adopts a normative juridical method with a conceptual and statutory approach, supported by case analysis. The findings reveal that criminal liability enforcement against corporations remains weak due to the suboptimal application of the strict liability principle, the minimal use of restorative sanctions, and the lack of clear mechanisms for environmental recovery. Therefore, this thesis proposes an ideal punishment model that integrates environmental restoration, the imposition of more effective fines, and standalone remedial sanctions. The study also emphasizes the need for systemic reform in Indonesia’s environmental law enforcement through regulatory revision and the enhancement of judges' competence via full implementation of Supreme Court Decree Number 134/KMA/SK/IX/2011 on environmental judge certification. With an ideal punishment pattern, it is expected that corporations will face stronger deterrents and that ecological justice can be sustainably achieved.
