Abstract
In Indonesia, DNA testing is often used as one of the scientific means of evidence to prove or refute an individual’s involvement in a legal event. However, the regulation concerning DNA testing has not yet been comprehensively governed by statutory law, particularly with regard to the legality of collecting specimens for DNA testing without the consent of the sample owner. Law Number 36 of 2009 on Health, as amended by Law Number 17 of 2023, and Law Number 23 of 2006 on Civil Registration, as amended by Law Number 24 of 2013, indeed provide provisions on the protection of personal data. Nonetheless, they do not specifically address the issue of DNA testing and the legality of specimen collection conducted without the consent of the individual concerned, rendering this issue a legal grey area that requires further examination. This study aims to analyze the legality of collecting DNA specimens without the consent or permission of the sample owner, as well as its implications for the evidentiary system in Indonesia. This thesis adopts a normative juridical research method with a statutory and regulatory approach. The findings of the study indicate that collecting specimens without the subject’s consent raises serious concerns regarding the right to privacy and the legal protection of individuals. Based on the 1945 Constitution of the Republic of Indonesia and Law Number 8 of 1981 on the Criminal Procedure Code (KUHAP), every piece of evidence must be obtained through lawful means. The unauthorized collection of DNA specimens may constitute a violation of the right to privacy as guaranteed by law, and may render the resulting DNA evidence inadmissible in court. This study further explores the role of medical ethics and privacy law in determining the legal validity of DNA evidence in judicial proceedings, and provides recommendations for the formulation of clearer and more specific regulations regarding the procedures for collecting DNA specimens.
