Abstract
Education plays a crucial role in the advancement of a nation. Currently, Indonesia has more than 400,000 educational institutions, encompassing both general educational institutions and Islamic-based educational institutions, one of which is the Islamic boarding school (pondok pesantren). Islamic boarding schools are Islamic educational institutions that play a significant role in educating the nation's citizens and fostering moral values in accordance with Islamic teachings. Although these Islamic educational institutions are regulated under Law No. 18 of 2019 on Pesantren, in practice, criminal acts still occur within such institutions, causing harm to students. Over the past two years, Islamic boarding schools have gained a negative image due to the emergence of cases of violence experienced by students within their premises, ranging from physical abuse to sexual violence. One notable case is the physical violence leading to death at an Islamic boarding school in Bantul Regency, Yogyakarta, recorded under Verdict No. 27/Pid.Sus-Anak/2022/PN.Btl. This study specifically explores legal accountability and legal protection from a civil law perspective regarding unlawful acts committed by Islamic boarding schools against students who experience physical violence within their environment. The research employs a normative legal method with a case study approach and legal framework analysis. The findings indicate that Law No. 18 of 2019 clearly stipulates the rights to legal protection for students in Islamic boarding schools. Furthermore, it demonstrates that Islamic boarding schools can be held civilly liable for acts of physical violence against students within their premises, provided that the elements of unlawful acts are fulfilled.
