Abstract
In the application of the death penalty, there are still many pros and cons in the community for drug offenders. While some people believe that this is an appropriate punishment and can provide a deterrent effect, others believe that the death penalty violates human rights and has no deterrent effect at all. Law No. 35 of 2009 provides for the death penalty for drugs. The purpose of this study is to investigate the use of the death penalty from the point of view of expediency. This research uses an interview-based data collection strategy combined with a conceptual approach and statute approach. The results show that the death penalty can provide a deterrent effect to the perpetrator, and also provide benefits such as protection to the community. In addition to providing a deterrent effect, the death penalty also provides benefits to victims and other communities. However, the application of the death penalty must also be balanced with law enforcers who are good and firm in carrying out the application of the death penalty in order to provide the expected benefits.
