Abstract

The current criminal justice system tends to be punitive in nature, necessitating strategic criminal policy reforms, particularly in handling cases of narcotics abuse. The imposition of rehabilitation for narcotics users, implemented through a restorative justice approach, can optimize the resolution of narcotics abuse cases. This study aims to explore the urgency of reformulating the application of restorative justice for narcotics users through rehabilitation and to analyze how restorative justice can be integrated into the law enforcement system in Indonesia. This research employs a normative juridical approach. The findings emphasize the pressing need to implement rehabilitation for narcotics users using restorative justice, driven by health, social, and criminal policy considerations. Reformulating the criminal sanctions in Article 127 of Law Number 35 of 2009 on Narcotics is crucial to ensure consistency and integrity in the application of law, creating a unified legal standard where all narcotics users have a structured and guaranteed opportunity for rehabilitation. Several strategic steps are recommended to optimize the implementation of this policy. First, reformulating Article 127 of Law Number 35 of 2009 on Narcotics to eliminate inconsistencies in the application of imprisonment. Second, integrating the restorative justice approach at all stages of legal proceedings, not merely as part of internal regulations such as Perkap, Perja, or PERMA. Third, conducting a judicial review of Article 127 of Law Number 35 of 2009 on Narcotics to examine the constitutionality of imprisonment as a sanction for narcotics users.
