Abstract
Divorce has become an increasingly prevalent social phenomenon in Indonesia, reflecting changes in the social, economic, and cultural aspects of society. One of the significant consequences of divorce is the issue of child custody (hadhanah) which often leads to prolonged conflicts between the parents. In the case of the divorce between celebrities AS and TM, despite the court granting custody to TM, both children remain under the father's care. This study aims to analyze the issue of custody of children who have not yet reached the age of discernment (mumayyiz) where the custody was awarded to the father after divorce. This research is a normative legal study that references relevant regulations and a case-based approach. The cases reviewed are two relevant rulings: Cibinong Religious Court Decision Number 1073/Pdt.G/2017/PA.Cbn and Bandung High Religious Court Decision Number 292/Pdt.G/2019/PTA.Bdg. The findings of the study confirm that according to the Compilation of Islamic Law (KHI), custody of children who have not yet reached the age of discernment should be granted to the mother. Meanwhile, a father attempting to forcibly take custody of the child may be subject to civil sanctions.
