Abstract

This study examines corporate criminal liability concerning the misuse of personal data within the framework of Indonesia's Personal Data Protection Law (UU PDP) and related regulations. With the increasing reliance on digital platforms, personal data has become a valuable asset, posing significant risks of misuse. This research addresses two critical issues: the scope of corporate criminal liability for personal data misuse and the ideal legal framework for ensuring accountability. Employing a normative juridical approach, the study analyzes statutory and conceptual perspectives to evaluate legal gaps and enforcement challenges. It also explores the role of key doctrines such as functional perpetration, direct liability, and vicarious liability in attributing responsibility to corporations. The findings highlight inadequacies in enforcement mechanisms under UU PDP and propose integrating procedural regulations, such as Supreme Court Regulation No. 13/2016, to enhance accountability. By addressing these shortcomings, the study aims to foster legal certainty and strengthen personal data protection in Indonesia's rapidly evolving digital landscape.
