Abstract
This research aims to examine the potential legal vacuum in the enforcement process by the BPOM (Indonesian National Agency of Drug and Food Control) regarding cases of contaminated cough syrup for children that bear BPOM certification. The research method used in this paper is normative juridical. conducted by examining literature materials in the form of statutory regulations. Contaminated cough syrup for children has become a serious issue because it has led to acute kidney injury in children who consumed it, with some cases resulting in death due to this condition. However, Indonesian law has not yet addressed this issue adequately, as there is currently no regulation specifying sanctions for the BPOM in cases of negligence in performing its duties as the regulator of drugs and food in Indonesia.
