Abstract
The purpose of this research is to compare the application of employment agreements with non disclosure/confidentiality clauses and non-competition clauses (NCC) between Indonesia and the United States and to determine the rights of workers after the expiration of employment agreements with confidentiality and non-competition clauses. This research uses normative juridical method with statute approach and comparative approach. The results of this research show that in Indonesia, the application of employment agreements with confidentiality and non-competition clauses is still not explicitly regulated in law. However, the content of the clause is the basis for the company to sue violators of the clause. In the United States itself, confidentiality agreements are very commonly used for the benefit of the company. However, non-competition clauses are not allowed to be used after the FTC regulation as a form of effort to protect workers. This regulation should be adopted as an effort to protect workers' rights in Indonesia.
