Abstract

The Certificate of Title issued by the National Land Agency is the highest legal evidence to provide certainty of official land ownership and reduce the potential for conflict. However, the phenomenon of overlapping certificates, namely when one plot of land has more than one certificate claiming the same ownership occurred in Supreme Court Decision Number 232/K/Pdt/2013. The purpose of this research is to find out the legal remedies against overlapping certificates of ownership based on applicable law in Indonesia and the legal settlement of overlapping certificates of ownership based on Supreme Court Decision Number 232/K/Pdt/2013. The writing of this article uses normative legal research methods with statutory and case approaches. The formulation of the problem to be discussed in this research is legal remedies against overlapping certificates of ownership based on applicable law in Indonesia and legal settlement of overlapping certificates of ownership based on Supreme Court Decision Number 232/K/Pdt/2013. The results show that conflict resolution can be done through litigation and non- litigation channels, including mediation involving the National Land Agency. The research also identifies the need to improve the land administration system to reduce the potential for overlapping certificates in the future. As such, this research makes an important contribution to the development of land law policy in Indonesia.
