Abstract

This research discusses Gojek's legal responsibility as a GoSend service provider to consumers who are harmed by the practice of illegally transferring driver accounts. Based on Law Number 8 of 1999 concerning Consumer Protection, consumers have the right to security, comfort, and safety. Although Gojek has made efforts to provide a safe service, weaknesses in the driver identity monitoring and verification system have the potential to cause losses to consumers, including embezzlement of goods by unverified drivers. This study uses a normative juridical method with a descriptive qualitative approach, focusing on the analysis of related regulations and legal protection mechanisms provided to consumers, as well as Gojek's legal responsibilities from the perspective of default, unlawful acts, and the principle of strict liability. The results of the study show that even though Gojek has made efforts to protect consumers, it is still necessary to strengthen the security, supervision, and consumer education system to improve legal protection in accordance with applicable laws and regulations.
