Abstract

An acquittal occurs when the act committed by the defendant is proven, but the act is not a criminal act or the act committed by the defendant is proven and constitutes a criminal act, but there is a reason for eliminating criminal liability. In practice, an acquittal decision can occur when material conditions in the indictment are not met which are not objected to by the Defendant/Legal Advisor, as happened in Decision Number 107/Pid.B/LH/2019/PN Pbm. The aim of this research is to find out the conditions that must be met in handing down an acquittal decision and to analyze the considerations made by the judge in handing down an acquittal decision on an indictment that does not meet the material requirements. The type of research used in this research is normative research with a statutory approach and conceptual approach which is supported by primary, secondary and tertiary legal materials. The results of this research show that the imposition of an acquittal verdict occurs not solely because an act is not included in a criminal act because there are reasons for eliminating criminal liability, but can occur because the material requirements in the indictment are not fulfilled which are based on a method of legal interpretation of the provisions of Article 191 paragraph (2) of the Criminal Procedure Code.
