Abstract
Intellectual Property (IP) has a strategic role in supporting the development of the creative economy in Indonesia, whose contribution will reach 7.8% of Gross Domestic Product (GDP) by 2023. As a valuable economic asset, IP has the potential to become an object of fiduciary guarantee, especially for IP that has been registered so as to obtain Intellectual Property Rights (IPR) as stipulated in Law Number 24 of 2019 and PP Number 24 of 2022. However, in the implementation, there are still obstacles, one of which is the absence of a special institution and authorized to assess the economic value of an IPR, as well as the lack of trust of the banking sector in the stability and consistency of the valuation process. This study highlights the opportunity for the Directorate General of Intellectual Property (DJKI) to establish an official valuation mechanism as already implemented in several countries. In addition to establishing an IPR valuation institution, it is also necessary to develop supporting regulations and training for experts to be able to provide professional valuations and according to international standards. This effort aims to encourage optimal utilization of IPR in economic activities, increase asset credibility in the eyes of creditors, and strengthen the role of DJKI in supporting the growth of the creative economy in Indonesia. This research uses a normative juridical approach with descriptive analysis of relevant regulations and international practices.
