Abstract
Sexual violence still occurs in Indonesia, this is proven by the high number of violence recorded in 2023 in data from the Ministry of Women's Empowerment and Child Protection, totaling 29,883 victims and data from the National Commission on Violence Against Women, totaling 289,111 victims. Unfortunately, the data presented does not specifically explain the forms of sexual violence reported, especially forced marriage. The problem is how the crime of forced marriage is regulated in Indonesia and what guarantees of protection the state provides to victims of forced marriage. The research method used is normative juridical with a statutory approach and conceptual approach. The results of the research show that the fulfillment of rights and guarantees for victims of sexual violence, including forced marriage, is contained in laws and regulations that specifically regulate criminal acts of sexual violence. Therefore, to be able to implement it requires cooperation between the competent Ministries and State Institutions. One form of fulfilling the guarantee of protection for victims of forced marriage can be realized through UPTD PPA and also LPSK, but unfortunately UPTD PPA is not owned by all provinces in Indonesia. In fact, the existence of UPTD PPA can support the handling, protection and recovery of victims, victims' families and/or witnesses. For this reason, Provincial and Regency/City Governments are obliged to form UPTD PPA to support efforts to fulfill legal protection for victims of forced marriage.
