Abstract
This study strives to analyze the function of the Indonesia-China Mutual Legal Assistance (MLA) agreement in combating human trafficking involving Indonesian ship crew on foreign-flagged fishing vessels. The research employs a normative juridical method using a statutory and case approach, using data source from a library research on regulations, international conventions, and legal literature. The findings show that MLA is essential in addressing cross-border jurisdictional challenges through inter-state coordination for investigation, prosecution, and victim protection. However, optimizing MLA requires strengthening national legal frameworks, enhancing law enforcement capacity, ratifying the ILO C188 Convention of 2007, and effective bilateral diplomacy. These findings underscore the importance of a collaborative human rights-based approach to protect Indonesian ship crew from exploitation and ensure more effective law enforcement.
