Abstract

The profitability of the gold mining sector in Indonesia has been a strong magnet for businesses to enter the business. However, this sector has a high risk of legal violations in licensing, environmental management, and local community rights. This research analyzes law enforcement against illegal gold mining industry business actors who employ foreigners in Indonesia and the responsibilities of illegal gold mining industry business actors who employ foreigners in Indonesia. The method used in this research is normative, using a statutory approach and a case approach. The method of data collection uses library research and data collection techniques using descriptive qualitative. The results of this study indicate that law enforcement against illegal gold mining industry business actors who employ foreigners in Indonesia and the sanctions that have been determined have not been fully effective in stopping illegal gold mining. Business actors as employers are fully responsible for ensuring the validity of the documents of foreign workers employed in accordance with applicable regulations. However, in practice, many business actors ignore this obligation.
