Abstract

This study aims to analyze the elements of default in the insurance agreement between customers and PT AXA Mandiri Financial Service based on Case Decision Number 3/Pdt.G/2021/PN.Bjm. Insurance is an important mechanism in mitigating financial risks due to unforeseen events, where policyholders obtain financial security through premium payments according to agreements with insurance companies. In Indonesia, the insurance sector is regulated by Law Number 40 of 2014 concerning Insurance, which covers operational aspects and provides legal protection for insurance activities. Insurance plays a vital role in providing peace of mind and economic stability for individuals and companies. However, non-compliance or default in the fulfillment of obligations by insurance companies can cause conflicts with policyholders. This study uses juridical-normative methods to evaluate the consistency and application of laws related to insurance defaults in Indonesia. The results of the study show that there is a default in this case, which requires legal action to enforce the rights of policyholders. This study emphasizes the urgency of compliance with legal agreements and regulations in ensuring the protection of the rights of all parties involved in insurance contracts, and offers new findings related to the application of default law in the context of insurance in Indonesia.
