Abstract

This study aims to analyze the role and responsibility of the state in restoring the rights of child victims of wrongful arrest in Indonesia and examine the impacts of wrongful arrest on children from legal, social, and psychological perspectives. The research employs a normative juridical method with a statutory and case approach. The findings reveal that the state has the obligation to provide compensation and rehabilitation for child victims of wrongful arrest through mechanisms stipulated by laws, such as Law No. 39/1999 on Human Rights and Government Regulation No. 7/2018. The impacts of wrongful arrests on children include legal uncertainty, social stigma, and prolonged psychological trauma. Therefore, systematic efforts are needed to improve the legal protection mechanisms for children in Indonesia.
