Abstract

The progress and development of e-commerce has made it not only an online buying and selling platform, but also provides various interesting services, one of which is the service provided by e-commerce Shopee, namely the online loan service known as Shopee Pinjam (SPinjam). Agreements in online money loans are usually packaged in the form of a standard agreement which allows for the inclusion of an exoneration clause which could harm one of the parties in a weaker position, namely the debtor. Thus, it can create an imbalance or injustice in the agreement. This writing aims to find out the principles of justice in the SPinjam agreement which contains an exoneration clause and the position and legal responsibilities of the parties involved. The type of research used is normative juridical by examining legal materials using library research methods. The research results show that the agreement in SPinjam contains an exoneration clause in the form of transferring and limiting the responsibilities of the Funder to the Fund Recipient which is contrary to statutory regulations, resulting in an imbalance and injustice towards the rights and obligations of the parties. Apart from that, the position of the parties involved has been explained in POJK Number 10/POJK.05/2022. The responsibilities of the parties involved in SPinjam are determined to guarantee the rights and interests of each party. If a mistake or negligence is committed by one party and causes harm to the other party, the party at fault must provide compensation for his or her actions. However, the current LPBBTI regulations do not yet clearly explain the responsibilities of the parties if they make mistakes or negligence that harm other parties.
