Abstract

The purpose of this paper is to provide legal certainty and provide a clear definition and scope of the phrase “misdemeanors” as one of the grounds for impeachment of the President according to Article 7A of the 1945 Constitution. This study uses normative legal research methods and uses comparative methods with statutory and comparative approaches. The results of this writing provide clear boundaries so that they can be a reference for the formulators of legal products to revise and / or create new and special legal rules that contain arrangements regarding misconduct so as to create legal certainty in Indonesian legislation. This writing also discusses the analysis of the interpretation of “misdemeanors” which is associated with the method of forming laws and regulations in Indonesia and the theory of legal certainty, the result of which is that the regulation of the phrase “misdemeanors” in Indonesia is still multi-interpretive and needs to be reviewed to create legal certainty.
