Abstract
Significant changes in transaction patterns driven by the COVID-19 pandemic and the rapid development of AI across various business sectors in Indonesia present great opportunities but also significant legal challenges. These challenges highlight the urgent need for comprehensive and effective regulations to govern the use of AI in legal contexts, which currently remain insufficiently specific. This research aims to identify the legal risks associated with the use of AI technology in digital transactions in Indonesia and explore mitigation measures. Normative juridical research method used to examine legal norms and relate them to the problems raised by conducting a literature study of related legislation and legal regulations, books, scientific articles, and dictionaries which will be analyzed with real cases that occurred in Indonesia. The findings reveal that the use of AI in digital transactions in Indonesia carries significant legal risks, including personal data breaches, misuse of information, and lawsuits arising from system failures. The discussion also highlights risk mitigation efforts through the regulatory sandbox approach and the importance of strengthening regulations that specifically govern AI usage. The research recommends adopting a regulatory sandbox to test compliance with new regulations before commercial implementation, as well as fostering collaboration between the government, private sector, and civil society to build a responsive and secure AI ecosystem in Indonesia.
