Abstract
The scope of this research focuses on analyzing the elements of criminal offenses in cases of online gambling promotion through social media, in accordance with the provisions in Article 27 paragraph (2) which reads “Every person who intentionally and without right distributes, transmits, and / or makes accessible Electronic information and / or Electronic documents that have gambling content as referred to in Article 27 paragraph (2) shall be punished with a maximum imprisonment of 6 (six) years and / or a maximum fine of Rp1 million. The analysis will cover the elements of the offense, such as promoting by posting stories on social media accounts and disseminating information containing online gambling through social media accounts. In addition, this research will also examine and evaluate the suitability of the criminal sanctions applied in Decision No.871/Pid.Sus/2022/PN Tjk. This study will consider the effectiveness and deterrent effect given to the perpetrators of online gambling promotion on social media.
