Abstract
The purpose of the research is to analyze the legal regulation of the crime of child trafficking in the Indonesian criminal law system and to analyze the efforts to prevent the crime of child trafficking through child adoption by involving several institutions related to this matter. This research uses a normative research method by using statute approach and conceptual approach. The results of this study explain that the criminal act of child trafficking carried out with the modus operandi through child adoption begins with a foundation that conducts the adoption process but does not follow the applicable procedures in the statutory arrangements. The crime of trafficking in persons has indeed been regulated in Law number 21 of 2007 on the Eradication of the Crime of Trafficking in Persons, but it has not specifically regulated the crime of trafficking in children. Therefore, there is a need to update the law on this matter. In terms of eradicating the criminal act of child trafficking, it can be done through two legal efforts, namely penal efforts and non-penal efforts by involving the role of related institutions so that later it can achieve more optimal results.
